PERLINDUNGAN KONSUMEN FINTECH P2P LENDING: KOMPARASI UU PERLINDUNGAN KONSUMEN DENGAN PRINSIP ADIL DAN AMANAH

This study aims to comparatively analyze consumer protection in peer-to-peer (P2P) lending and sharia fintech between Law Number 8 of 1999 on Consumer Protection and the Islamic legal principles of justice (adil) and trustworthiness (amanah). The main problem examined is the adequacy of the positive legal framework in addressing digital risks such as opaque electronic contracts, aggressive debt collection, and personal data misuse. The method employed is normative juridical with comparative and conceptual approaches. Primary legal materials include the Consumer Protection Law, POJK 10/POJK.05/2022, and related DSN-MUI fatwas, analyzed through content analysis. The results show that the Consumer Protection Law is reactive and emphasizes information disclosure and post-harm remedies, while the principles of adil and Amanah rooted in the Qur’an and Hadith offer preventive standards that prohibit exploitation, gharar, and betrayal of trust. A novel finding of this study is the identification of regulatory dualism in sharia fintech that creates both gaps and opportunities for integration. The study proposes embedding amanah-based data fiduciary duties and adil-based contract fairness tests into OJK supervisory guidelines.
